PRIVACY NOTICE FOR EMPLOYEES

This Privacy Policy explains how Accord Corporation Ltd. (“Accord”, “we”, “us” or “our”), collects, uses, and discloses (“process” or “processing”) your Personal Data in the course of our business, in accordance with the Personal Data Protection Act (A.D.2019) (“PDPA”).

We advise you to read this Privacy Policy in its entirety.

  1. When does this Privacy Policy apply to you

    This Privacy Policy applies to you if you are a candidate who seeks to apply for a job position with Accord (“Candidate”).

  2. What types of Personal Data does Accord collect from you?

    (a) Accord collects various types of your Personal Data, which can be used to identify you as an individual, whether directly or indirectly (“Personal Data”), including your full name, title, gender, address, email address, contact number, work experience, educational background, language skills, other skills, salary, qualifications, professional experience, professional license number, national identification number, passport number, picture (photo), images and motions captured by CCTV installed at Accord’s premises, and any other Personal Data, which you may voluntarily provide to Accord when applying for a position with Accord.

    (b) Where the Candidate provides Personal Data of other persons, such as his/her business referees, to Accord, the Candidate is responsible for ensuring that such other persons have been duly informed of the collection and disclosure of their Personal Data and necessary consent has been duly obtained, or else there must be other lawful legal basis for disclosing such Personal Data to Accord.

    (c) During recruitment process, Accord may collect data pertaining to your religion and/or blood type (“Sensitive Personal Data”) if such data contains in the copy of your national identification card. Accord does not intend to collect such Sensitive Personal Data nor any other types of Sensitive Personal Data as prescribed by the PDPA at this recruitment stage and therefore, Accord encourages you to blind and/or remove such data prior to submitting the copy of Identification Card, and/or any other documents to Accord.

  3. Why does Accord collect and process your Personal Data?

    (a) Consent:

    a. To retain your resume and any other Personal Data provided to Accord during recruitment process, and to contact and send the Candidate an information on the employment opportunities in the future, if any.

    b.To process your Sensitive Personal Data which you may provide to Accord via resume or during the interview session. Accord will ensure to retain your Personal Data which is only necessary and relevant for purposes prescribed herein and therefore, Accord will use its best endeavor to remove or blind any unnecessary or irrelevant Sensitive Personal Data as described above.

    c. The Candidate may withdraw his/her consent at any time, subject to the conditions under the applicable laws. Withdrawal of your consent will not affect any processing of your Personal Data for which you have lawfully provided consent prior to such withdrawal.

    (b) Contractual Necessity: To proceed with Candidate’s request to apply for a position with Accord whereby the resume will be submitted to Accord by the Candidate, and to arrange for interviews and necessary testing in order to assess and determine qualification, suitability and eligibility of the Candidate for employment with Accord. Failure to provide required or necessary Personal Data may result in Accord being unable to proceed with your request to apply for a position with Accord or request relating to the recruitment, either in part or in whole.

    (c) Legal Obligation: : To comply with applicable law or regulations, both domestic and foreign, and to comply with order of the court, competent authorities, and/or government agencies. Failure to provide required or necessary Personal Data may result in Accord being unable to proceed or undertake any act relating to the recruitment process, either in part or in whole, or that Accord and/or the Candidate may be found to be in violation of applicable law or regulation or order of competent authorities.

    (d) Legitimate Interest: In certain circumstances, Accord may need to process your Personal Data to detect and prevent fraud or other criminal activity, and to protect property, personnel, rights and interests of Accord, including the use of CCTV to monitor you while visiting Accord’s premise.

    (e) Legal Claims: Processing of Personal Data of Candidate when it is necessary for the establishment, compliance, exercising or defense of legal claim by Accord.

  4. Where does Accord collect your Personal Data?

    (a) Directly from you: We normally collect your Personal Data directly from you (the “Data Subject”), when you apply for a job position with us via online channel or in person.

    (b) Referring persons: We may collect your Personal Data from other persons, such as our employees in case of referral.

    (c) Third Parties: We may also collect your Personal Data from online public sources, recruitment agencies or companies.

  5. To whom does Accord disclose your Personal Data?

    (a) Accord may disclose Personal Data of the Candidate to its affiliates or group companies, both within and outside Thailand for the purpose relating to your recruitment and prospect employment, including to your prospect manager or supervisor to consider your job application.

    (b) Accord will not disclose Personal Data of the Candidate to any third parties, unless your application for employment with Accord is successful.

    (c) Accord may disclose Personal Data of Candidates to any other persons or entities only to the extent that Accord is required to make disclosure by applicable laws or regulations.

  6. Where does Accord transfer your Personal Data?

    (a) We may transfer your Personal Data to our affiliates and our regional office located outside Thailand and which may have different data protection standards to those prescribed by the data protection authority in Thailand. Notwithstanding that, we ensure that we will protect your Personal Data by implementing adequate personal data protection standards for the transfer of your Personal Data outside Thailand. We will also ensure that any entity to whom your Personal Data will be disclosed will implement adequate personal data protection standards.

    (b) In all cases, we will transfer your Personal Data only where it is permitted and in compliance with the PDPA.

  7. For how long does Accord retain your Personal Data?

    (a) For unsuccessful Candidate, Accord will retain your resume and Personal Data provided during recruitment process for 10 years after the end of your recruitment process. Thereafter, Accord will securely delete, destroy or de-identify your Personal Data.

    (b) For successful Candidate, Accord will transfer your Personal Data, including Sensitive Personal Data, provided during recruitment process to the file designated for Employee.

  8. What are your rights in relation to your Personal Data?

    You are entitled to:

    (a) Request to have access to and obtain a copy of your Personal Data, and to request the disclosure of the source of the Personal Data, in the event that your Personal Data was collected without your consent;

    (b) Receive your Personal Data in a commonly used and machine-readable format, and to have your Personal Data in said format transmitted to another Data Controller;

    (c) Request that your Personal Data be deleted, destroyed, or de-identified;

    (d) Object to the collection, use, and disclosure of your Personal Data, and especially where such collection, use, or disclosure is for direct marketing purposes;

    (e) Request that the processing of your Personal Data be suspended;

    (f) Request that your Personal Data be corrected, updated, or completed;

    (g) Withdraw your consent at any time, provided that there is no other legal ground for Accord to continue with the processing of your Personal Data; and

    (h) Lodge complaints to the competent authority.

    Your request may be refused, and the exercise of your rights is subject to the limitations prescribed by law.

  9. Change to this Privacy Notice

    Changes in this Privacy Policy will be notified to you via email or post we will give you the opportunity to express your consent for processing your Personal Data for different and new purposes, or we will in any case inform you about the legal basis of such processing other than consent. The time stamp you see on the policy will indicate the last date it was revised.
